JK Can Stand On Own: Mirwaiz

Asserting that Jammu and Kashmir could stand on its own feet on the basis of its ample resources, the chairman of the Hurriyat , Mirwaiz Umer Farooq, today implied that an independent existence could also be sustained with World Bank help. “We will have to stand on our own feet, and take our resources into our own hands so that no one asks how we can manage the finances to run a government,” the Mirwaiz told a meeting of the Kashmir Traders and the Manufacturers Association after the conclusion of a blood donation camp held in connection with the anniversary of Maulana Muhammad Farooq. “Our state has abundant resources, but the people are not getting the full benefit,” he said. “India extracts four times of what it spends on the state, and its expenditure here is not a favour to the Kashmiri people,” he said. “Our power is sold to outside states. Though we have a potential of over 50,000 megawatts, our homes are still in darkness,” he said. The Mirwaiz said that the state had sufficient resources to warrant it going its own way. “The World Bank provides loans to the entire world. Why can`t we approach it for finance?” he said. “At the moment, we should get at least a 50 per cent share of our resources. We will ensure a full accounting, and will never forfeit our rights,” he said. Asking traders in Kashmir and across the LoC to give an impetus to the commerce between the two sides, the Mirwaiz said that obstacles were being created in the process, which, he promised, his alliance would remove. He asked the government of India to provide banking and communication facilities to the traders on the two sides to boost cross-LoC commerce.

APHC has to draw a line for the future dispensation of Kashmir: Mirwaiz

All Parties Hurriyat Conference organized a one day seminar under the title “ Kashmir issue, plebiscite and election process.” The seminar was presided by Chairman APHC Mirwaiz Molvi Mohammad Umer Farooq , speaking on the occasion he said that we are observing martyrs week to commemorate the sacrifices rendered by our martyrs, which include Shaheed-e-Milat Maulana Mohammad Farooq , Shaheed-e-Hurriyat Kh. Abdul Gani Lone , besides martyrs of Hawal and others , who have crafted the way for achieving the cherished goal to which APHC is well determined .
Mirwaiz said:“ Kashmir tangle has both internal and external dimensions – at internal dimension there are two parties Pakistan and India ,who are directly involved to the dispute and prime party to the imbroglio are people of Kashmir – external dimension is that there are some world powers ,who are watching the situation at distant but not having the expound details ,”adding, “ Hurriyat is not against democratic doctrines , we have asked people of Kashmir to stay away from sham election process with the intention that democratic norms should be well defined and meant to solve the long pending Kashmir issue –which is the nuclear flash point between two neighboring countries of the sub-continent – our urge to the world community is that if they listen to India or Pakistan , they must also listen to common Kashmiris ,and feel their plight, agony and pain – who are the first causality to the dispute.”
“ APHC does believe in democracy and wants to solve the vexed issue of Kashmir through democratic verdict by the mode of referendum or Plebiscite –but the sham elections in Kashmir which have been carried since 1952 till to this date ,does not have any bearing on the nature of the dispute – our quorum believes in peace and it should evolve out of the situation in an honourable and dignified manner –Hurriyat wants to solve Kashmir issue at political front through meaningful dialogue,” Mirwaiz, added, elections rejection rally of 21st May has been called to express to the civilized world that APHC is the custodian of the sacrifices of common stock of people of Jammu Kashmir and farce elections are no way a substitute for the right to self determination .
Chairman Mirwaiz Umer Farooq reiterated that APHC has to draw a line for the future dispensation of Kashmir , respecting the wishes, sentiments and aspirations of Common Kashmiris ;every dispute gets solved when the disputing parties sit together and reach to an acceptable agreement like that of Ireland , which should be at par with the ambition of the people ,who are main party to the dispute –Kashmir have sustained the ongoing freedom struggle , it is because of the armed struggle of 90’s that Kashmir tangle has come out from cold storage and is discussed at international level : the freedom struggle will continue politically till to the logical conclusion .
Mirwaiz Umer Farooq maintained that when geographically small countries like France, England can have the permanent seats in UN ,why India doesn’t have - the main impediment keeps her away from the seat is lingering of Kashmir dispute, if India wants to achieve a respectable position in civilized world, it is mandatory upon India to give Kashmir a basic democratic right- right of right to self determination – so that Kashmiris can decide their future through adult franchise by means of referendum or plebiscite ; APHC is never against the socio- economic growth of India but they must give people of Jammu Kashmir their due right to decide their future -to which Hurriyat is wedded and meant for.
Executive member APHC and Chairman Muslim Conference Professor Abdul Gani Butt in his brief speech said that elections are only for achieving chair, while as right of right to self determination through referendum or plebiscite is for deciding the future , which is carried once in a life time of a nation to settle on the dispute , so elections in Kashmir have always been a futile practice . Professor cautioned: “We Kashmiris especially Pro-freedom leadership have to intermingle Principles with pragmatism , so our policies and programmes must be well defined asking for a strategy to tame the tide of change , and we must introspect in view of the changing world situation – Indians have given their verdict in recent parliamentary elections for stability , and rejected communalism, fanaticism and sectarianism , while as Pakistan is fighting war against extremism in Swat, Waziristan etc ., for perpetual stability , at the same time some strategists believe that Kashmir as a dangerous part on the map of South Asia.”
In this context meaningful dialogue is the only way out – now that a global change is sweeping across the parties involved in Kashmir will have to do the talking particularly with reference to nuclear weaponization of the sub-continent, where two hostile nuclear countries be involved in a dispute like Kashmiris , the international community will have to intervene with a view to warding off the ghosts of nuclear war. Therefore the dispute on Kashmir will have to be addressed in all cases and other all circumstances . But while talking the larger interest of peace and stability a deeper sense of responsibility in the higher degree of responsibility in conjunction of course with pragmatism and accommodation: APHC will have to work heard and draw up a plan to deal with the situation –and not build houses on stand . Recognize somber realities , preserve your position and work out an extraordinary strategy to writ people in India ,in Pakistan and in Kashmir of tension and insecurity ,this can happen only if and when dispute on Kashmir is resolved, and we have to define our roadmap in the new world order , so that every party achieves win-win position and have no feeling of sense of defeat, this is the only mode through which we Kashmiris as a weak nation can attain the political target, Professor said .
Acting Chairman Peoples league and Executive Member APHC Mukhtar Ahmad Waza maintained that the 1st martyrdom of Shaheed-e-Azeemat Sheikh Abdul Aziz must be also commemorated in same style . While speaking in the seminar he that the Kashmiris would never forget sacrifices of their martyrs, who have laid their lives for securing inalienable Right to Self-determination. He said Elections have been held since 1947, but it has proved to be a futile exercise and will remain so unless and until Kashmir issue is resolved as per the wishes and aspirations of Kashmiri people. Hurriyat Conference represents the sentiments and sacrifices of the Kashmiris. Our agenda is the settlement of the Kashmir issue and that is why we have termed elections as non-issue. Waza urged people to participate in the Eidgah March in a large number and demonstrate to the world that their resolve to continue the liberation struggle could not be defeated by Indian state terrorism. Fazal Haq Qureshi executive member APHC , while speaking on the occasion said that the mission of martyrs shall be taken to the logical end ,come what may.
Another Executive member ,chairman Anjuman Sharie Shiyan , Agha Syed Hassan Almoslvi Alsafvi said that elections in Kashmir is a futile practice , which can not change the nature of the dispute .. President Itihad-ul Muslimeen and executive member Masroor Abbas Ansari in an impressive speech said that we have to carry on the ongoing freedom movement in disciplined manner and have to predetermine our political targets . President Mahaz-e-Azadi and Senior Hurriyat leader Mir Mohammad Iqbal in his lecture expressed full faith on the leadership of Mirwaiz Molvi Mohammad Umer Farooq as Chairman APHC , while as another Hurriyat leader Mohammad Yousuf Naqasah also spoke in the same tone . Kashmir was never part of India: Mian Qayoom

Kashmir dispute has been discussed in some of the top forums of the world including the United Nations and European Parliament. But rarely has it reverberated in highest judicial body of occupied Kashmir, the High Court.
The President of High Court Bar Association, Mian Abdul Qayoom, presenting its arguments in delimitation case, said that the court that Jammu and Kashmir was never part of India, and plebiscite in accordance with the United Nations’ resolutions was yet to take place in JK.
The other points of his arguments are as follow:
The Bar President termed the demand for fresh delimitation, as sought by the petitioner, Bhim Singh of Panthers Party, a move by the government of India to change status quo of Jammu and Kashmir through its stooge governments in the occupied territory and to avoid final settlement of the Kashmir dispute according to the UN resolutions.
Mian Abdul Qayoom, quoting judgments of the Indian Supreme Court argued that postponing delimitation till 2026 was not violation of the democratic rights, as it didn’t affect elections. He said the Delimitation Commission constituted in 1981 submitted its report in 1995 and till then three elections were held in the territory without delimitation of assembly constituencies.
The Bar President said the so-called legislature of occupied Kashmir passed amendments in Section 47 of its constitution and the People’s Representation Act in 2002, and Bhim Singh was party to these amendments. “But in 2007 all of a sudden Singh filed petition to challenge the amendments ostensibly to garner support and popularity in a section of people in Jammu,” Qayoom said, terming the petition malafide and politically motivated.
Qayoom then quoted resolutions of the UN on Kashmir. He said that convening of the Constituent Assembly by the National Conference on October 1950 was the biggest fraud played on people of Jammu and Kashmir. The NC had convened the constituent assembly to determine the future shape and affiliations of the Jammu and Kashmir. He said that the Security Council resolutions explicitly say that the decisions of the constituent assembly would have no bearing on the Kashmir dispute.
The Bar President then quoted Article 253 of Indian Constitution, which says consent of the J&K government has to be obtained in event of its final disposition. “Therefore this is implicit recognition of the UN resolutions and the international dimension of the issue,” Qayoom said, adding the final settlement of the dispute is yet to take place.
Mian Qayoom argued the government of Jammu Kashmir doesn’t mean the government of Jammu and Kashmir in its present form that is being formed through farcical election process to carry administrative work. “JK government in its present form has to conduct day-to-day business and it can’t take decision to determine the future of people of Jammu and Kashmir. The Article 253 indicates about a separate government to be specially created to look how the plebiscite would be conducted in JK under UN,” he said.
The Bar President said the so-called assembly of occupied Kashmir ratified the accession when Sheikh Abdullah, who sold Kashmir to India, was in jail, and another stooge, Bakshi Ghulam Muhammad, the then prime minister, was in charge. ”Various agreements between India and Pakistan on Kashmir indicate that Kashmir is disputed territory and people have not been given their right to exercise the plebiscite, he argued.
Mian Qayoom pointed out that the present state of Jammu and Kashmir was disturbing where draconian acts like Armed Forces Special Powers Act and Disturbed Areas Act were in force. He said there was no democracy in the territory and elections were being held in one part and curfew was clamped in the other.
Referring to the discrimination part agitated by Bhim Singh in his petition, Qayoom took back the Court to the Treaty of Amritsar of 1846 when Kashmiris were sold along with land and animals to Dogra Maharaja. He said the rule of Dogra Maharajas was tyrannical. He said Kashmiris have been ousted from bureaucracy and police, and now by seeking readjustment of seats an attempt was being made to gain political power to change the status quo of JK to stall its final settlement.
The petitioner Bhim Singh, Bar President said, describes in the petition that he speaks on behalf of people of Jammu and Kashmir. “He represents, if at all he really represents, only a certain section in Jammu,” He concluded his argument by asking for dismissal of the petition.
In April 2002, the National Conference administration had brought a constitutional amendment in section 47 of the constitution of Jammu and Kashmir and in the Peoples Representation Act that explicitly says it was not necessary to readjust the assembly seats till 2026.
The Panthers Party President Bhim Singh filed petition in the Indian Supreme Court against the amendment, but withdrew it after he was told to approach an appropriate forum. Then he filed a petition in the High Court, claiming present composition of Assembly was highly biased against Jammu region, which was allocated only 37 seats against 46 seats for Kashmir region.”
Earlier, the division bench comprising Chief Justice, Justice Barin Gosh and Justice Mansoor Ahmad Mir heard senior counsel Zaffar Ahmed Shah who was speaking on behalf of the Bar on the issue. On last hearing the Chief Justice Barin Gosh had observed the Court would like to hear whether the amendment was destroying basic structure of the democracy or not. “If it does affect the democracy then it has to be explained how, and if it doesn’t that too has to be elaborated,” the Chief Justice had observed.
Zaffar Ahmed Shah answering the question said a constituency is determined on the basis of population, not on the basis of electors. “It is possible that within a population the electors can be less or more as compared to the population of other constituencies. The amendment doesn’t destroy the identity of the constitution and it continues to be democratic,” he said.
Shah said, “For readjustment of the constituencies census is necessary. The legislature has deferred the census till 2026 for the purpose of creation as well as re-adjustment of the constituencies.” He said in JK creation and alteration of the constituencies has nothing to do with the population. Describing the petition as mixture of politics, he said it was not maintainable and prayed for dismissal of the petition.

Obama administration might pressure India over Kashmir tangle

JKAPHC Media Cell: Former US ambassador to India Robert Blackwill has said that the Obama administration wanted good relations with India, but there could be a substantial change in Obama`s policies from that of the George W. Bush administration would take very hard work and skilful diplomacy from both the governments to keep the US-India relationship on its current level, he added.

Robert said that New Delhi might face pressure from the Obama administration over resolving the Kashmir dispute and on signing the CTBT. He thought the Obama administration`s current preoccupation with Pakistan and China had led to the downgrading of India in US` strategic calculations.

He was optimistic about the long-term prospects for Indo-US relationship, but he cautioned that in the immediate future bilateral ties were likely to be more problematic than had seen in recent years.

He singled out differing perceptions on Pakistan, Afghanistan, China, Iran, civil nuclear cooperation, CTBT, climate change, India`s nuclear weapons and protectionism as some of key problematical issues which could cause a variety of problems in the US-India relationship in the next months and years.

Leave Kashmir to Us, Stick To Your Job: Mirwaiz To NC

APHC Media Monitoring Service: Asserting that his alliance was the custodian of Kashmiri blood, the chairman of the Hurriyat , Mirwaiz Umer Farooq, on Monday lashed out at NC president, Dr. Farooq Abdullah, saying that the Hurriyat did not need pro-India figures to mediate for holding talks on the Kashmir issue. The Mirwaiz said that there would be no violent reaction around Jamia Masjid, if the forces desisted from provoking youth by placing restrictions. Apparently in response to Dr. Abdullah’s insinuation that that the Hurriyat was not clear on its stand whether it was with India, Pakistan or China, the Mirwaiz hit back saying that the agenda of his alliance was clear and that it stood for the permanent resolution of the Kashmir issue. Dr. Abdullah had roused the ire of the pro-freedom camp here by his statement Sunday asking the Hurriyat to come forth with its agenda and a road map on Kashmir so that the NC could help it at the New Delhi. Bristling at the suggestion, the Mirwaiz said that the pro-India forces, who, he said, had no business to extend invitations to the Hurriyat, could not go about advising the pro-freedom camp. “Whenever the Hurriyat has to talk to India of Pakistan on Kashmir, it will do so on its own strength. It does not require pro-India figures to mediate for it,” he said, adding, “The goals of the pro-India figures are limited to power and office, while the Hurriyat aims for freedom” “The pro-India forces should first work on the tasks assigned to them by the people. The Hurriyat will talk about Kashmir by itself,” he added . Mirwaiz said:“The Hurriyat Conference is not being allowed to take its point of view to the people. We are being stopped from discharging our religious duties, and being subjected to restrictions” Referring to Friday prayers at the Jamia Masjid, the Mirwaiz said that stone-pelting took place because of the restrictions by the police and the paramilitary forces. “The forces deliberately provoke the youth, inflaming them by posing obstacles in religious duties, and this leads to a reaction,” he said,“Let the forces end the curbs, allow freedom of movement to the Hurriyat leaders and the freedom to discharge religious duties to the public, and desist from keeping the people under siege, and I think there will be no flare up from the youth” Referring to the elections now underway in the state, the Mirwaiz said that the process would have no bearing on the status of the Kashmir issue even if 100 per cent votes were cast.
